In a majority decision of four judges to one, the apex court set aside the judgments of the Federal High Court, Birnin-Kebbi, and the Appeal Court, which had affirmed Alhaji Haruna Dandio as the PDP candidate in the Senate race.
In the judgment prepared by Justice Chima Nweze and read by Justice Amina Augie, the Apex Court held that both lower courts had erred in assuming jurisdiction over the matter.
